Driver Service Agreement
Governs the conditions for taxi drivers using driver mode, the ride flow, conduct rules and the processing of location data.
The data controller's identity has not been filled in for this installation yet; it is marked "[…]" in the text. The identity form in the factory panel must be completed before the app is submitted to the stores.
1. Parties and scope
This Driver Service Agreement (the "Agreement") is made between […] (the "Service Provider"), which operates the Ağrı Sosyal Şehir app (the "App"), and the person who is registered as a driver in the App's taxi module and uses driver mode (the "Driver"). The Agreement is layered on top of the Terms of Use; the Terms of Use, the Privacy Policy and the Community Guidelines also apply to the Driver.

The App is installed for one city only; this Agreement covers the taxi service provided in the Ağrı installation. Driver mode is not a separate app: the Driver signs in to the main App with their own account, and driver mode opens once the city administration has registered them as a driver.
2. Nature of the service
- The App is an intermediary that brings together a passenger hailing a taxi and the Driver. The contract of carriage is formed between the passenger and the Driver (or the taxi business the Driver belongs to); the Service Provider is not a party to the transport service.
- The App does not set, collect or pay out the fare. The fare is calculated by the taximeter according to the city's taxi tariff and paid by the passenger directly to the Driver. The Service Provider takes no commission on trips.
- The city administration may change or close the taxi module and the driver registrations at any time; closing the module gives the Driver no right to compensation.
3. Conditions for being a driver
Driver mode is opened only to persons registered by the city administration. To be registered the Driver declares and undertakes the following:
- To be eighteen or older and to hold the driving licence and the other documents legislation requires for driving a commercial taxi (professional competence, psychotechnical assessment and the like, to the extent legislation requires).
- That the vehicle used is registered, licensed, insured and inspected as a commercial taxi, and that the plate and vehicle details are reported correctly to the city administration. To inform the city administration immediately when the plate or vehicle changes.
- If attached to a taxi station or taxi business, that the attachment is real and current. The city administration may require attachment to a taxi business before a driver application.
- To provide the documents the city administration requests. The Service Provider verifies documents to the extent legislation requires; the validity of the documents is the Driver's responsibility.
A false declaration is grounds for cancellation of the driver registration and an account sanction.
4. Independence
- The Driver provides the service independently, in their own name or in the name of the taxi business they belong to. This Agreement creates no employment, agency, partnership or representation relationship between the Service Provider and the Driver. The Driver is not an employee of the Service Provider; the Driver decides on working hours, time spent online and which request to accept.
- The Driver's tax, social security, professional chamber and licensing obligations belong to the Driver or to the business they belong to.
- While using the App the Driver uses the Service Provider's brand only within the driver identity in the App; the Driver may not give the impression, on the vehicle or elsewhere, of acting in the name of the Service Provider.
5. Ride flow
A trip proceeds in the App through the following steps; every step is recorded:
- Request: the passenger hails a taxi by entering the pickup point (and, if any, the drop-off point and a note). The request is forwarded to online and available Drivers.
- Acceptance: the first Driver to accept takes the trip. Acceptance is a commitment to the passenger; an accepted request is not abandoned without good reason.
- Arrival: when the Driver reaches the pickup point they report "arrived"; the passenger sees this.
- Trip: when the passenger gets in, the Driver starts the trip; the Driver's location is shown to the passenger for its duration.
- Completion: at the destination the Driver completes the trip. The fare is paid in the vehicle according to the taximeter.
- Cancellation: the passenger or the Driver may cancel with a reason before the trip starts. If no Driver accepts within a set time, the request closes as "no driver found".
The Driver receives no requests while offline; no new request is forwarded while a trip is in progress. The Driver is not obliged to accept every request received while online; systematically refusing certain areas or persons, however, counts as discrimination.
6. Conduct rules
Throughout the trip and in every contact with the passenger the Driver:
- Obeys traffic rules, the taxi tariff and legislation; runs the taximeter, asks no fare outside the tariff and does not lengthen the route for a higher fare.
- Treats the passenger with respect; insult, harassment, threats, discrimination and disturbing behaviour are forbidden. Does not use, keep or share the passenger's personal details (name, address, phone, location) outside the trip.
- Does not switch to driver mode under the influence of alcohol, drugs or any substance affecting the ability to drive.
- Uses the phone during the trip only as legislation permits.
- Keeps the vehicle clean and safe and uses the reported plate; does not let anyone else use their driver identity in the App and does not take trips with another Driver's account.
- Keeps items the passenger has forgotten and returns them to the passenger or the city administration.
- Does not use a request received through the App to move the ride outside the App by arrangement with the passenger.
A breach of these rules leads to suspension or cancellation of the driver registration and to the account sanctions in the Community Guidelines.
7. Complaints and ratings
- Passengers may complain about a trip or a Driver through the report flow in the App or by writing to destek@sosyalsehir.com; complaints are reviewed by the city administration and the Driver is given the opportunity to respond.
- The Driver may complain about a passenger through the same routes.
- The App currently collects no ratings for trips. If the city administration introduces a rating system in the future, this Agreement is updated and the Driver is notified.
- The city administration may suspend or cancel the driver registration in case of repeated or serious complaints; in a serious breach cancellation without notice is possible.
8. Processing of data
In driver mode the following data is processed; see the Privacy Policy for details:
- Driver record: name, phone, plate, vehicle details, attached station and business, online status.
- Location: while driver mode is on, and especially during a trip, the device's location is sent to the server at regular intervals. The live location is kept briefly to match requests and to show it to the passenger; the location pings during a trip are stored permanently as part of the trip record and used in examining disputes. No location is sent while driver mode is off.
- Trip records: the steps and times of every trip, pickup and drop-off points, cancellation reasons; there is no defined automatic deletion period for these records.
- What the passenger sees: when you accept a request the passenger sees your name, plate, vehicle and live location. The Driver sees the passenger's name, pickup point, drop-off point if any and note.
The Driver uses passenger data learned through the App only to carry out that trip; with regard to this data the KVKK obligations belong to the Driver and the business they belong to. The location permission can always be withdrawn in the operating system settings; without it driver mode does not work.
9. Liability and insurance
- The Driver and the business they belong to are responsible for damage to the passenger, third parties or the vehicle during carriage; taking out compulsory and optional insurance is the Driver's obligation.
- The Service Provider is not liable for damage arising from the passenger's conduct, non-payment, cancellation of a request, a technical outage of the App or an error of the location service. Except for intent and gross negligence, the Service Provider's liability is limited to the amount, if any, collected from the Driver.
- The Driver indemnifies the Service Provider against claims brought against it because of the Driver's conduct contrary to legislation while using the App.
10. Suspension and termination
- The Driver may switch driver mode off at any time and ask the city administration to remove the driver registration. The registration is not removed before a trip in progress is completed.
- The Service Provider or the city administration may suspend or cancel the driver registration in case of breach of this Agreement, the Community Guidelines or legislation, documents becoming invalid, repeated complaints or a safety concern.
- Removal of the driver registration does not close the personal account; the account continues under the Terms of Use. Past trip records continue to be kept for the resolution of disputes.
11. Governing law and changes
This Agreement is governed by the law of the Republic of Türkiye; the courts and enforcement offices at the Service Provider's place of residence have jurisdiction over disputes. When the Agreement changes the version date is updated, notice is given within the App and, where required, the Driver is asked to accept it again. For questions, destek@sosyalsehir.com.
